  This website (the "Site") is operated by Explore Gloucestershire ("we", "us", "our"). By accessing, browsing, using, submitting information to, or advertising on this Site, you agree to be bound by these Terms & Conditions.
  If you do not agree with these Terms & Conditions, you should stop using the Site immediately.
  2. Use of this Site
  You may use this Site for lawful purposes only. You agree not to:
  
    - Use the Site for any purpose that is unlawful, misleading, harmful, defamatory, or offensive.

  Unless you have our prior written permission, you must not use this Site for commercial purposes other than purchasing or enquiring about advertising, listings or promotional services provided by Explore Gloucestershire.
  You must not create a link to any page of this Site from another website without our prior written consent. We reserve the right to withdraw linking permission at any time.
  3. Business listings, events, offers and promotional content
  Explore Gloucestershire provides business listings, event listings, offers, features, news articles and other promotional placements for local businesses, attractions, venues and service providers. Some of this content is provided directly by those businesses or their representatives.
  By submitting any information, images, logos, descriptions, event details, offers or other material to us for inclusion on the Site (collectively "Submitted Content"), you confirm that:
  
    - You have the full right and permission to provide that content to us.
 
    - You grant Explore Gloucestershire a non-exclusive, royalty-free licence to use, edit, adapt, publish and display that content on the Site and in our marketing channels (including social media, email newsletters and promotional round-ups), for the purpose of promoting your business and/or the wider Gloucestershire visitor economy.
 
    - Your Submitted Content is accurate to the best of your knowledge at the time of submission.
 
    - Your Submitted Content does not infringe any copyright, trade mark or other third-party rights.
 
  
  We reserve the right, at our sole discretion and without obligation, to edit, decline to publish, pause, unpublish or remove any listing, event, offer, competition, news item or other Submitted Content at any time. This includes (but is not limited to) content which we consider to be inaccurate, misleading, out of date, inappropriate for our audience, in breach of these Terms & Conditions, or not in keeping with the tone or quality standards of Explore Gloucestershire.
  We also reserve the right to temporarily withhold or remove content where payment terms have not been met.
  4. Accuracy of information
  We aim to keep information on the Site accurate and up to date. However, much of the information, including (but not limited to) business descriptions, opening hours, facilities, admissions, menus, prices, availability, events and offers, is provided by third parties.
  We do not guarantee that any listing, event, offer, competition or article is accurate, current or complete. You are strongly advised to check directly with the business, organiser or venue before travelling, booking or making a purchase.
  Explore Gloucestershire is not responsible for any disappointment, cost, loss, damage or inconvenience resulting from reliance on information displayed on the Site.
  5. Payment, invoicing and publication of listings
  Some services on the Site (including paid listings, higher-tier promotional packages, sponsored content, competitions and banner advertising) are chargeable.
  Our typical process for paid listings and promotional packages is as follows:
  
    - You submit your details, description, images and logo via our online form.
 
    - We create a draft listing and provide you with a private link to review. At this stage the listing is hidden from navigation and search on the Site.
 
    - We will also provide you with a short checklist of categories and filters (for example: Visitor Attractions, Places to Eat, Places to Stay, Activities & Entertainment, Weddings, Birthday Parties etc). This allows us to place your business in all relevant sections so that it appears in multiple in-site searches.
 
    - Once you confirm you are happy with the listing content and category settings, we will issue an invoice.
 
    - Your listing will only be made publicly visible (and included in navigation and search) once full payment has been received within the agreed terms on the invoice.
 
  
  If payment is not received within the specified terms (normally by return unless otherwise agreed in writing), we reserve the right to delay publication or remove the listing, and/or pause any associated promotional activity, without further notice.
  We also reserve the right to remove any published listing, event or promotional content at any time, without refund, if:
  
    - Payment is overdue or remains unpaid;
 
    - We believe the content breaches these Terms & Conditions;
 
    - We believe the content is no longer appropriate for the Site or our audience;
 
    - We receive a complaint or legal challenge relating to the content;
 
    - The business repeatedly provides inaccurate, misleading or incomplete information.
 
  
  6. Intellectual property and copyright
  Unless otherwise stated, all content on this Site (including text, design, layout, graphics, logos, icons, images, code, databases, structure, look and feel, and overall presentation) is owned by or licensed to Explore Gloucestershire.
  You may view, print or download content from the Site for your own personal, non-commercial use only. You must not copy, reproduce, republish, re-use, modify, adapt, upload, post, distribute, transmit, scrape, data-mine or exploit any part of the Site or its content for commercial purposes without our prior written permission.
  You must not remove or alter any copyright notice, credit, logo, trade mark or legal notice on the Site or within any material downloaded or printed from the Site.
  If you upload or submit content (including logos, images, descriptions or event details) you confirm you have permission to use that content and to grant us the right to use it as described in section 3.

  The Site includes links to websites, content, services and platforms provided by third parties. These links are provided for your convenience and information only.
  We do not endorse and are not responsible for:
  
    - The content, security, accuracy, availability or policies of any third-party website;

  8. Competitions and prize promotions
  From time to time Explore Gloucestershire may run competitions or prize draws on behalf of ourselves and/or partner businesses. Additional terms may apply to individual competitions. Where competition-specific terms are provided, those terms will apply alongside these Terms & Conditions.
  Unless otherwise stated, prizes are provided by the business supplying the prize and not by Explore Gloucestershire. We are not responsible for the fulfilment, quality, availability, cancellation or postponement of any prize, experience, booking or event.
  We reserve the right to withdraw, amend or suspend any competition at any time without notice if we believe it is no longer viable, appropriate or fair.
  9. Limitation of liability
  To the fullest extent permitted by law, Explore Gloucestershire, its owners, employees, writers, contributors and suppliers:
  
    - Exclude all conditions, warranties, representations or other terms which might otherwise be implied by law, statute, common law or the law of equity;
 
    - Will not be liable for any loss, claim or damage (whether direct, indirect, special, incidental or consequential), including but not limited to loss of revenue, loss of anticipated savings, loss of business, loss of opportunity, travel or accommodation costs, or loss of reputation or goodwill, arising out of or in connection with:
      
        - Your use of or reliance on the Site;
 
        - Any interruption, delay or inability to access the Site;
 
        - Any error, omission, inaccuracy or outdated information published on the Site;
 
        - Any third-party content, listing, offer, event, service or website linked from the Site;

  12. Governing law and jurisdiction
  These Terms & Conditions, and any dispute or claim arising out of or in connection with them or the Site, shall be governed by and construed in accordance with the laws of England and Wales.
  You agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising from, or related to, your use of the Site.
